These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("Client," "you," "your") and Sadler.photo ("we," "us," "our") governing your use of the website https://sadler.photo (the "Site") and any photography services provided.

By accessing or using this Site, booking a photography session, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use this Site or our services.

1. Services Provided

Sadler.photo offers professional photography services including, but not limited to:

  • Portrait photography

  • Automotive photography

  • Pet and animal photography

  • Event photography

  • Digital image delivery and editing

All services are subject to availability and acceptance at our sole discretion. We reserve the right to decline any booking or service request for any reason.

2. Booking, Deposits & Payment

Booking Confirmation:

  • A photography session is not considered confirmed until:

    • A signed contract or booking agreement has been submitted (if applicable), AND

    • Any required deposit or full payment has been received

Payment Terms:

  • Deposit amounts and payment schedules will be communicated at the time of booking

  • Full payment must be completed before final edited images are delivered

  • Accepted payment methods will be specified during booking

  • All prices are in U.S. Dollars (USD)

Pricing:

  • Prices, packages, session lengths, and turnaround times are subject to change without notice

  • Any services or deliverables requested beyond the agreed-upon package may incur additional fees

  • Additional travel fees may apply for sessions outside the Tulsa, Oklahoma area

3. Cancellations, Rescheduling & Refunds

Client-Initiated Cancellations:

  • Clients must provide at least 48 hours' notice for cancellations or rescheduling requests

  • Cancellations made with less than 48 hours' notice may result in forfeiture of any deposit paid

  • No-shows will result in full forfeiture of deposit or payment

Photographer-Initiated Cancellations: Sadler.photo reserves the right to cancel or reschedule sessions due to:

  • Severe weather or hazardous conditions

  • Illness or personal emergency

  • Equipment failure or technical issues

  • Unsafe shooting conditions or environments

In such cases, the Client will be offered the option to reschedule or receive a full refund of any payments made.

Refund Policy:

  • Deposits are generally non-refundable except in cases of photographer-initiated cancellations

  • Refunds, if applicable, will be issued within 14 business days

4. Image Delivery, Editing & Turnaround Time

Delivery Timeline:

  • Estimated turnaround times will be provided at the time of booking

  • Delivery timelines are estimates only and are not guaranteed

  • Turnaround times may vary based on session complexity, workload, and seasonal demand

Editing Style:

  • All edited images are delivered at the photographer's creative discretion and artistic style

  • Editing includes color correction, exposure adjustment, and creative enhancement as deemed appropriate

RAW Files:

  • Unedited RAW image files are never provided under any circumstances

  • Only fully edited, final images in JPEG or other specified formats will be delivered

Revision Requests:

  • Minor revision requests may be accommodated at the photographer's discretion

  • Extensive re-editing or alterations beyond the original scope may be subject to additional fees

5. Copyright, Ownership & Usage Rights

Copyright Ownership: All photographs created by Sadler.photo are protected under United States Copyright Law (Title 17, U.S. Code). The photographer retains full copyright ownership and all intellectual property rights to all images.

Client License: Upon full payment, the Client receives a non-exclusive, non-transferable, personal-use license to use the delivered images for:

  • Personal printing for private display

  • Posting on personal social media accounts (with photographer credit)

  • Sharing with friends and family for personal purposes

Prohibited Uses: Clients may NOT, without express written permission:

  • Use images for any commercial purposes, advertising, or business promotion

  • Sell, license, or distribute the images

  • Edit, alter, crop, apply filters, or otherwise modify the images

  • Remove or obscure watermarks, signatures, or metadata

  • Enter images into contests or competitions without permission

  • Claim authorship or ownership of the images

  • Use images for any purpose that could be considered defamatory, obscene, or illegal

Commercial Licensing: Commercial use of images requires a separate written licensing agreement and payment of applicable licensing fees. Contact us to discuss commercial licensing options.

6. Model Release & Image Usage Rights

Marketing & Portfolio Use: By participating in a photography session with Sadler.photo, the Client grants permission for the resulting images to be used by the photographer for:

  • Portfolio and website display

  • Social media marketing and promotion

  • Advertising and promotional materials

  • Print or online publications

  • Competitions and awards submissions

Opt-Out Option: If the Client does not consent to the above usage, written notice must be provided before the session begins. Opting out may affect pricing or availability.

Minors: For any participants under the age of 18, consent must be provided by a parent or legal guardian.

Model Release Forms: A separate model release form may be required for certain sessions or commercial projects.

7. Client Responsibilities & Conduct

Clients agree to:

  • Arrive on time and adequately prepared for the session

  • Follow reasonable direction from the photographer regarding posing, positioning, and safety

  • Ensure all session participants are cooperative and respectful

  • Maintain a safe, respectful, and professional environment

  • Disclose any relevant medical conditions, mobility limitations, or safety concerns prior to the session

Missed Coverage: Sadler.photo is not responsible for missed photographs or incomplete coverage due to:

  • Client or participant late arrival or absence

  • Non-cooperative subjects or disruptive behavior

  • Environmental conditions beyond the photographer's control (weather, lighting, venue restrictions)

  • Third-party interference or unexpected circumstances

8. Liability, Assumption of Risk & Indemnification

Assumption of Risk: Photography sessions may involve physical activity, outdoor environments, interaction with vehicles or animals, public locations, or other potentially hazardous conditions. By booking and participating in a session, the Client acknowledges and assumes all personal risk of:

  • Personal injury or bodily harm

  • Property damage or loss

  • Accidents or unforeseen incidents

Release of Liability: To the fullest extent permitted by law, the Client releases, waives, and discharges Sadler.photo, its owner, employees, and affiliates from any and all liability, claims, demands, or causes of action arising from or related to:

  • Personal injury, illness, or death

  • Loss, theft, or damage to personal property

  • Any accidents or incidents occurring during or after the photography session

Indemnification: The Client agrees to indemnify and hold harmless Sadler.photo from any claims, damages, or expenses arising from the Client's actions, negligence, or violation of these Terms.

Property Damage: Sadler.photo is not responsible for lost, stolen, or damaged personal property during sessions. Clients are responsible for securing their own belongings.

9. Loss of Data or Equipment Failure

While we take extensive precautions to protect and back up all digital files, in the rare event of:

  • Equipment failure or malfunction

  • Data corruption or loss

  • Theft, fire, natural disaster, or other circumstances beyond our control

Sadler.photo's liability is strictly limited to one of the following remedies:

  • A complimentary rescheduled session, OR

  • A full refund of any payments made for the session

Disclaimer: Sadler.photo is not liable for:

  • Consequential damages

  • Emotional distress

  • Lost opportunities or special occasions that cannot be recreated

We strongly recommend clients maintain their own backups of delivered images.

10. Website Use & Intellectual Property

All content on this Site, including but not limited to:

  • Photographs and images

  • Logos, branding, and trademarks

  • Text, graphics, and design elements

  • Code and software

Is the exclusive property of Sadler.photo and is protected by United States and international copyright, trademark, and intellectual property laws.

Prohibited Actions: You may not:

  • Copy, reproduce, distribute, or download any content without written permission

  • Use content for commercial purposes

  • Reverse engineer, modify, or create derivative works

  • Remove copyright notices or proprietary markings

Unauthorized use may result in civil and criminal penalties, including legal action.

11. Third-Party Links & Services

This Site may contain links to third-party websites, social media platforms, or external services. Sadler.photo is not responsible for:

  • The content, accuracy, or practices of third-party sites

  • Privacy policies or terms of service of external platforms

  • Any damages or losses resulting from your use of third-party services

Use of third-party links is at your own risk. We encourage you to review the terms and privacy policies of any external sites you visit.

12. Termination of Service

Sadler.photo reserves the right, at our sole discretion, to:

  • Refuse or decline service to any individual or entity

  • Cancel confirmed bookings or contracts

  • Terminate access to this Site

  • Suspend or discontinue any services

At any time, for any reason, including but not limited to:

  • Violation of these Terms

  • Harassment, threatening behavior, or abusive conduct

  • Unsafe or disruptive behavior during sessions

  • Non-payment or fraudulent payment activity

  • Any conduct we deem inappropriate or detrimental to our business

In cases of Client misconduct or Terms violations, no refunds will be provided.

13. Dispute Resolution & Governing Law

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law principles.

Jurisdiction & Venue: Any legal action or proceeding arising out of or relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Tulsa County, Oklahoma. You consent to the personal jurisdiction of such courts.

Arbitration (Optional): The parties may mutually agree to resolve disputes through binding arbitration in accordance with the rules of the American Arbitration Association.

Waiver of Class Actions: You agree to resolve disputes on an individual basis only and waive any right to participate in class action lawsuits or class-wide arbitration.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with any booking agreements, contracts, or invoices, constitute the entire agreement between you and Sadler.photo regarding the use of this Site and our services, and supersede all prior or contemporaneous agreements, understandings, or representations.

16. Changes to These Terms

Sadler.photo reserves the right to update, modify, or revise these Terms at any time, with or without notice. Changes will become effective immediately upon posting to this page with a new "Last Updated" date.

Your continued use of the Site or services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
